Sex Offense Definitions

The following are the definitions of conduct prohibited by Western Iowa Tech’s sexual harassment policy: 

Sexual Harassment

Prohibited acts of sexual harassment may be committed by any person upon any other person, regardless of the sex or sexual orientation of those involved.  

Unwelcome behavior (verbal, written, physical) that is directed at someone because of that person’s sex or gender, and that meets any of the following definitions: 

Quid Pro Quo

An employee, agent, or contracted individual of Western Iowa Tech Community College  conditions the provision of an aid, benefit, or service upon an individual’s participation in unwelcome sexual conduct. 

Hostile Environment Harassment

Unwelcome conduct on the basis of sex, that is so severe, pervasive, and objectively offensive that it effectively denies a person equal access to a College education program or activity.

Sexual Assault or Abuse

One of the following offenses in which one has or attempts to have sexual contact or sexual penetration, with another individual without their consent: 

Rape

Penetration, no matter how slight, of the vagina or anus, with any body part or object, or oral penetration by a sex organ of another person without consent of the Complainant.

Fondling

Intentional touching of the clothed or unclothed genitals, buttocks, groin, breasts, or other body parts of the Complainant by the Respondent or, the Respondent by the Complainant, without the consent of the Complainant, for the purpose of sexual degradation, sexual gratification, or sexual humiliation.

Incest

Sexual intercourse between persons who are related to each other within the degrees wherein marriage is prohibited by law.

Statutory Rape

Sexual intercourse with a person who is under the statutory age of consent. 

Dating Violence

Violence, committed by a person, who is in or has been in a social relationship of a romantic or intimate nature with the Complainant. 

The existence of such a relationship shall be determined based on the Complainant’s statement and with consideration of the length of the relationship, they type of relationship, and the frequency of interaction between the person involved in the relationship.  

Domestic Violence

Felony or misdemeanor crime of violence, committed by a current or former spouse or intimate partner of the Complainant, by a person with whom the Complainant shares a child in common, or by a person who is cohabitating with, or has cohabitated with, the Complainant as a spouse or intimate partner, or by a person similarly situated to a spouse of the Complainant under the laws of the State of Iowa or the jurisdiction in which the incident reported occurred; or by any other person against an adult or youth Complainant who is protected from that person’s acts under the laws of the State of Iowa. 

Stalking

Engaging in a course of conduct, on the basis of sex, directed at a specific person, that would cause a reasonable person to fear for the safety of themselves or others; or suffer substantial emotional distress. 

Sexual Exploitation

One person taking non-consensual or abusive sexual advantage of another for their own advantage or benefit, or to benefit or advantage anyone other than the one being exploited, and that behavior does not otherwise constitute one of the other sexual misconduct offenses.
